Terms & Conditions of Sale
Version 1 · 2026-06-01
Effective 2026-06-01. These Terms & Conditions of Sale ("Terms") form a binding contract between you ("you", the "Buyer") and TRYB International, LLC, a Delaware limited liability company with its registered office at 131 Continental Dr, Suite 305, Newark, DE 19713, New Castle County, Delaware, United States ("Fleurinelle", "we", "us"), operating the website fleurinelle.com and related services (the "Platform"). By placing an order you confirm you have read, understood and agree to these Terms, our Privacy Policy, Refund & Cancellation Policy, Delivery Policy and Cookie Policy, which are incorporated by reference.
1. Who we are and what we do
Fleurinelle is an online marketplace that connects buyers, typically located outside Morocco, with independent, vetted partner shops located inside Morocco (each a "Partner Shop"). We facilitate the order, collect payment, and manage all customer support. The Partner Shop prepares and delivers the flowers on our behalf. Fleurinelle does not itself grow, hold, arrange or deliver flowers.
2. Orders and formation of contract
2.1 An order is an offer by you to purchase. The contract of sale is formed between you and Fleurinelle when we send you an order confirmation, and fulfilment is performed by a Partner Shop on our behalf.
2.2 You are responsible for the accuracy of all information you provide, including the recipient's name, telephone number and delivery address, the delivery date, and the card message. We are not liable for a failed or delayed delivery caused by inaccurate or incomplete information you provided.
2.3 You confirm you are at least 18 years old and legally able to enter into this contract, and that you are the authorised holder of the payment method used.
3. Prices, currency and payment
3.1 All prices and delivery fees are shown in full before you pay. No fee is added after payment.
3.2 You may pay in a supported display currency; conversion is applied at checkout. Card payments are processed by our payment processors (Stripe and/or TRYB Billing). Fleurinelle does not store your full card details.
3.3 By submitting payment you authorise us to charge the total shown. We may pre-authorise and later capture the amount in line with our Delivery Policy.
4. Products, photography and substitution
4.1 Product images are representative. Fresh-flower supply varies by season, market and day. Where a specific stem is unavailable, the Partner Shop may substitute flowers of equal or greater value in the same colour family and style, in accordance with our Substitution Policy. Such substitution does not entitle you to a refund.
4.2 The delivery photograph taken at the door is the definitive record of what was delivered.
5. Delivery
Delivery is governed by our Delivery Policy. Delivery windows are estimates within stated ranges and are not guaranteed to the minute. Same-day cut-off times are published per city.
6. Cancellations and refunds
Cancellations and refunds are governed by our Refund & Cancellation Policy. Please raise any issue with Fleurinelle support first; we resolve the large majority of concerns quickly and fairly.
7. Chargebacks and payment disputes
7.1 You agree to contact Fleurinelle support and allow us a reasonable opportunity to investigate and resolve any problem before initiating a chargeback or payment dispute with your bank or card issuer.
7.2 You acknowledge that we retain evidence of each transaction — including your acceptance of these Terms, the date and time of consent, your IP address and device information, order details, delivery confirmation and the door-step delivery photograph — and that we will submit this evidence to contest any chargeback we believe to be unwarranted.
7.3 Initiating a chargeback for an order that was delivered, or that was substituted or partially refunded in accordance with these policies, is a breach of these Terms. We reserve the right to recover sums improperly charged back, together with reasonable costs, and to suspend your access to the Platform.
8. Acceptable use
You agree not to misuse the Platform, submit false information, place fraudulent orders, use it for unlawful, threatening or harassing content in card messages, or attempt to contact or identify the Partner Shop outside the Platform.
9. Disclaimers and limitation of liability
9.1 To the maximum extent permitted by law, the Platform and products are provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9.2 We are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profit, goodwill or emotional distress.
9.3 Our total aggregate liability to you for any claim arising out of or relating to an order or these Terms shall not exceed the total amount you actually paid for that order.
9.4 Nothing in these Terms excludes liability that cannot be excluded by applicable law.
10. Force majeure
We are not liable for any failure or delay caused by events beyond our reasonable control, including weather, strikes, civil unrest, government action, public-health measures, carrier or supply failures, or outages of third-party services.
11. Indemnification
You agree to indemnify and hold harmless Fleurinelle, its officers, employees and Partner Shops from any claim, loss or cost (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, or inaccurate information you provided.
12. Governing law and dispute resolution — binding arbitration and class-action waiver
12.1 These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules.
12.2 Please read this section carefully — it affects your legal rights. Any dispute, claim or controversy arising out of or relating to these Terms or an order shall be resolved exclusively by final and binding individual arbitration administered under the Commercial Arbitration Rules of the American Arbitration Association. The seat of arbitration is Delaware; proceedings may be conducted remotely.
12.3 Class-action waiver. You and Fleurinelle agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative or class proceeding.
12.4 Small-claims and injunctive relief. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.
13. Changes to these Terms
We may update these Terms from time to time. The version in force at the time of your order governs that order. Material changes are posted on the Platform with an updated effective date.
14. Severability and entire agreement
If any provision is held unenforceable, the remainder continues in full force. These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and Fleurinelle concerning your orders.
